Welcome to our website. If you continue to browse and use this website you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Oyster Moon’s relationship with you.

The terms “you” and “your” refer to the user, viewer, or customer of our website.

Oystermoon.co.uk is a site operated by Oyster Moon, a registered partnership between Michele Davies and Gina Ricci.

Right to Cancel

You will not have the right to cancel a purchase for the supply of any of the following goods:

Bespoke and personalised goods:

We are unable to refund for items that have been designed to your specification or clearly personalised.

We are unable to offer a refund or exchange if there is a mistake (for example if there is a spelling error). It is your responsibility to ensure that the design is correct at proof stage.

We are happy to refund or reprint if you find there is a fault with the print process of your design. Please contact us.

Other goods:

You have the right to cancel the purchase of a good without having to give a reason at any time within the ‘cooling off period’ of seven working days, beginning on the day after you received the goods.

If you are in possession of the goods you are under the duty to retain them and take reasonable care of them. You must send the goods back to us at our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the contract.

We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense.

Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation.

If your order is delayed in arrival due to an incorrect address entered on your order you may need to wait up to an additional 14 days for it to arrive. If a replacement is required you will be charged a slightly discounted rate for this service.

If your item does not arrive due to being lost in the post, or arrives damaged in transit, we will replace your item immediately upon receiving a photograph of the damage with a reprint of your design with no extra cost to you. If an item is not delivered within our delivery estimates it does not constitute grounds for a refund as our dates are estimates only; a replacement will be shipped immediately if the item does not arrive within a reasonable amount of time.

Copyright

By creating a design on this site you accept soul responsibility and liability for your designs. If a design you create infringes a third party’s copyright due to the content you supply we accept no liability for any legal or financial damages incurred by claims made against you by the copyrights holder(s).

Designs created on Oyster Moon are not under any circumstances to be resold either for profit, or for the purpose of providing (a design service) for clients who are not direct customers of Oyster Moon. Items are for personal, or limited corporate use. Use of designs for any purposes other than those listed in these terms and conditions is prohibited without prior and express permission from Oyster Moon.

Colour Printing/Hand-painted products.

In some cases there might be a slight discrepancy between colours displayed on screen and the colours on your print or canvas.

Notices

(Notice will be deemed received and properly served 24 hours after an email is sent or three days after the date of posting of any letter.) In providing the service of any notice, it will be sufficient to prove in the case of a letter, that the letter was properly addressed, stamped and placed in the post and, in the case of an email that the email was sent to the specified email address of the addressees.

Conclusion

These terms are governed by English law. Any contract for the purchase of goods from this site and any dispute or claim arising out of or in connection with any such contract will be governed by English law. You and we both agree that the course of England and Wales will have non-exclusive jurisdiction. However, if you are a resident in Northern Ireland you may also bring proceedings in Northern Ireland and if you are in Scotland you may also bring proceedings in Scotland.
